Bolingbrook Municipal Transfer Stamp

The Village of Bolingbrook requires a municipal real estate transfer stamp for most property sales within village limits. You must get this stamp before the Will County Recorder will record the deed. Call the Bolingbrook Village Clerk at (630) 226-8430 for current procedures and the stamp fee schedule. The stamp is obtained from the village, not the county.

Some Bolingbrook transfers are exempt from the municipal stamp. Transfers between spouses, certain estate transfers, and other specific types of conveyances may qualify for an exemption. Even if exempt, you will typically need a written exemption form from the village before the Recorder accepts the deed. Contact the village clerk's office early to determine whether your transfer needs the stamp or an exemption letter. Do not skip this step or your deed will be rejected at the county level.

Recording Requirements

Illinois deed requirements are set by 765 ILCS 5. A deed must be signed by the grantor and notarized. It must include the full legal description of the property. The first page needs a three-inch blank top margin for the Recorder's stamp. The PIN must appear on the deed. The document must state the name and address of the person to receive the recorded copy back after filing. Missing any of these items means the deed is rejected.

Before recording, you must file a MyDec transfer declaration with the Illinois Department of Revenue at mytax.illinois.gov/MyDec. Complete the declaration online and print the confirmation. Attach it to the deed at the time of recording. All transfers need a declaration, including exempt ones. For exempt transfers, enter the applicable exemption code. The Recorder will not process the deed without the MyDec confirmation attached.

Fees and Transfer Taxes

Will County recording fees are governed by 55 ILCS 5/3-5018. The base fee for a document up to four pages is $98. This includes the $18 Rental Housing Support Program surcharge required statewide. Pages beyond four cost extra. Call (815) 740-4637 to confirm the current fee for your specific document before recording.

State transfer tax under 35 ILCS 200 is $0.50 per $500 of the sale price. Will County adds $0.25 per $500. The Bolingbrook municipal transfer tax is a third charge, paid separately to the village before recording. All three taxes are based on the sale price. The state and county taxes are collected at the Recorder's office at recording time.
